A parent or legal guardian must create the account, book, pay, provide information, and complete all required forms for a minor. Additional age, supervision, or participation requirements may apply to specific offerings.

  1. CLASSES, EVENTS, AND OFFERINGS

Class descriptions, schedules, instructors, locations, capacity, and availability may change.

A reservation is confirmed only after you receive a booking confirmation and complete any required payment.

Kiind Studio may substitute an instructor, modify an offering, combine or cancel a class, or close registration when reasonably necessary. If Kiind Studio cancels a paid offering, the credit or refund stated in the applicable booking policy will apply.

Some offerings at Kiind Studio are provided by independent instructors, practitioners, renters, or businesses. Unless expressly stated otherwise, these providers are independent from Kiind Studio and are responsible for their own qualifications, services, representations, and conduct. Additional terms or waivers may apply.

  1. PRICES, PAYMENTS, PACKAGES, AND REFUNDS

Prices, taxes, fees, package rules, expiration dates, and promotional terms are displayed at the time of purchase and may change for future purchases.

You authorize Kiind Studio and its payment processor to charge the payment method you provide.

Cancellations, late cancellations, no-shows, credits, package use, transfers, and refunds are governed by the policy displayed during booking and our Cancellation and Refund Policy.

Unless otherwise stated or required by law, purchases are nonrefundable. Promotional offers have no cash value and may be subject to additional restrictions.

  1. PARTICIPANT RESPONSIBILITIES

You agree to:

• Follow posted studio rules and reasonable directions from staff and instructors.

• Use equipment properly and participate responsibly.

• Treat participants, employees, instructors, practitioners, and the premises respectfully.

• Refrain from threatening, discriminatory, harassing, disruptive, unsafe, or unlawful behavior.

Kiind Studio may refuse entry, end participation, suspend an account, or remove a person when reasonably necessary for safety, operations, policy enforcement, or legal compliance.

  1. FITNESS, WELLNESS, NUTRITION, AND SOUND OFFERINGS

Yoga, Pilates, strength training, fitness, breathwork, meditation, sound healing, wellness education, and nutrition education involve individual considerations and may produce physical or emotional responses.

These offerings are educational and recreational. They are not medical treatment, diagnosis, psychotherapy, physical therapy, or individualized medical nutrition therapy. The term “sound healing” describes a wellness practice and does not promise to diagnose, treat, or cure any condition.

Consult an appropriately licensed healthcare professional before participating if you are pregnant, have a medical condition or injury, take medication, or have concerns about whether an activity or nutrition topic is appropriate for you.

Stop participating and seek assistance if you experience pain, dizziness, shortness of breath, or another concerning symptom.

Participation may require a separate liability waiver, health acknowledgment, emergency form, or parental consent form. Nothing in these Terms waives any right or liability that cannot legally be waived.

  1. STUDIO RENTALS AND INDEPENDENT BUSINESSES

Submitting a rental inquiry does not reserve the studio or create a tenancy, employment relationship, partnership, agency, franchise, or joint venture.

Studio use is confirmed only through a separate written rental or license agreement and completion of any required payment, insurance, credential, and approval requirements.

Independent instructors, practitioners, and renters are responsible for following applicable laws, maintaining appropriate credentials and insurance, and obtaining participant agreements for their own offerings.

  1. CHARITY CLASSES AND DONATIONS

Kiind Studio may host donation-based or charity classes benefiting local nonprofit organizations. The beneficiary and donation structure will be identified for each event.

Unless expressly stated otherwise, payments for regular classes, services, or rentals are purchases and are not represented as tax-deductible charitable donations. Kiind Studio does not provide tax advice.

  1. EMPLOYMENT AND SKILLS-LEARNING OPPORTUNITIES

Kiind Studio’s employment and no-cost skills-learning initiatives are separate from its publicly available classes, studio rentals, and customer purchases.

Website descriptions do not guarantee employment, placement, compensation, eligibility, or participation.

Employment must be confirmed through separate written employment documentation. No-cost skills-learning opportunities are subject to their own eligibility, supervision, safety, and participation requirements. Kiind Studio does not charge a participation fee for these learning opportunities.

Kiind Studio’s total liability for a claim arising from the website or online services will not exceed the greater of the amount you paid Kiind Studio for the relevant service during the six months before the claim or $100.

This provision does not require you to indemnify Kiind Studio for Kiind Studio’s own negligence or wrongful conduct and does not limit nonwaivable consumer rights.

Before filing a claim, you and Kiind Studio agree to make a good-faith effort to resolve the dispute through written notice and 30 days of discussion.

If the dispute is not resolved, an action may be brought in a court with jurisdiction in Nassau County, New York, unless applicable consumer law allows another location. Either party may seek emergency relief or use small-claims court when eligible.
